ACC and their partners are pleased to inform you of last week’s victories. The umbrella of ACC and ECC's lawyers secured eight results with a total amount awarded $280,602.

1st Court of Instance:

  • Club la Costa Sucursal - The nullity of the contract was determined by the lack of information regarding the contract length and accommodation details under Spanish law 04/2012, the client also won court costs. $16,200 awarded.
  • Anfi - The nullity of the contract was determined by the lack of information regarding the contract length and accommodation details under Spanish law 42/1998. The client also won court costs. $45,689 awarded.
  • Diamond Resorts - The nullity of the contract was determined by the lack of information regarding the contract length and accommodation details under Spanish law 42/1998. The client also won court costs $21,128 awarded.

Appeals:

  • CLC Paradise - The Court of Appeal has confirmed our victory in the first instance. In this case, the magistrates have taken into consideration the price of the last contract to include what had been paid in previous contracts. The client also won court costs. $29,995 awarded.

  • CLC Sucursal - In the First Instance, the Judge estimated the award to be around $54,676 however, the Court of Appeal recognizes that it is $83,801 which was another blow for CLC at this appeal. Adrian our lawyer is going to personally congratulate the client after making the journey to Malaga from the UK to testify. The client also won courts costs. $83,801 awarded.

  • CLC Continental - The Court of Appeal has confirmed our victory in the first instance confirming the nullity of the contract. The client also won court costs. $19,051 awarded

  • CLC Paradise Trading - A small part of CLC's appeal was upheld but only regarding the assessment of a further year's reduction. Apart from that, the judgement remains untouched from the 1st Instance. $15,509 awarded.

  • CLC Continental - Another blow to CLC Continental, the 1st Instance sentence is confirmed in its entirety following an extensive analysis of all the issues. The client also won court costs. $33,058 awarded.
