Seven positive awards amounting to $485,273 including two Marriott cases totalling over $127K each

ACC and their partners are pleased to inform you of the latest court victories for 2023. For December, M1 Legal secured SEVEN positive awards amounting to $485,273.  Of those, M1 secured TWO Marriott cases over £100K!.

Please see below a breakdown of the substantive results:

1st Court of Instance:

  • Onagrup x 2 - The judge declared the contracts null due to lack of property and/or contract duration information. (Laws 42/1998|04/2012).  Amounts awarded - $50,475, $20,500.
  • Marriott - In Marbella, the judge declared the contract null due to lack of contract duration information.  Amount awarded - $15,968.
  • Marriott - Also in Marbella, the judge declared the contract null due to lack of property information (Law 42/1998).  In addition, the defendant was ordered to pay the legal fees and costs of the proceedings.  Amount awarded - $130,710.

We also received a positive award against Elite Fuerteventura and another Marriott.

Appeals:

  • Club la Costa x 2 - The Court of Appeal has confirmed two judgments from the First Instance that declared the contract null due to lack of property and/or contract duration information. (Laws 42/1998|04/2012)    Amounts awarded - $25,068, $15,221.
  • Anfi - The Court of Appeal has confirmed the judgment from the First Instance that declared the contract null due to lack of property and contract duration information.   Amount awarded - $28,388.
  • Marriott - The Court of Appeal has confirmed the judgment from the First Instance that declared the contract null due to lack of property information.   Amount awarded - $168,780
  • Royal Park Albatros - The Court of Appeal has declared the contract null and void for lack of property and/or contract duration information. In addition, the defendant was ordered to pay the legal fees and costs of the proceedings.   Amount awarded - $13,198. 

We also received a positive decision against Diamond Resorts.

All cases mentioned above will now proceed to the next step.
