Fourteen positive awards totalling $379,022 including two cases against Marriott

ACC and their partners are pleased to inform you of the latest victories over the last two weeks. The umbrella of ACC and ECC's lawyers secured FOURTEEN positive awards with a total value of $379,022. 

Please see below a breakdown of the substantive results:

1st Court of Instance:

  • Marriott x 2 - At Marbella court numbers four and six, the judge declared the contract null due to lack of contract duration information, law 04/2012. Amounts awarded - $13,431, $66,598.
  • CLC Sucursal - At Arona court number one, the judge declared the contract null due to lack of contract duration information, law 04/2012. Amount awarded - $18,797.

We also received confirmation of another positive judgment against Blaue Investitionen Fuerteventura and CLC Continental Resorts.

Appeals:

  • Anfi x 4 - At the Court of Appeal in Las Palmas, it was confirmed that the judgements from the First Instance still stand that declare the contracts null due to lack of accommodation information, two were referencing Law 42/1998 and the other two, Law 04/2012.  Amounts Awarded - $27,411, $121,065, $18,615, $19,908.
  • CLC Sucursal - At the Court of Appeal in Malaga, it was confirmed that the decision regarding the loan at the First Instance was turned down, however, the timeshare contract is still declared null and void due to lack of accommodation information. (Law 04/2012).  Amount Awarded - $19,886.
  • CLC Paradise -  The Court of Appeal in Tenerife has confirmed in full the judgment from the First Instance declaring the contract null due to lack of accommodation information, (Law 04/2012).  Amount Awarded - $13,061.
  • CLC Sucursal - At the Court of Appeal in Malaga, it was confirmed in full the judgment from the First Instance declaring the contract null and void due to lack of accommodation information. (Law 04/2012).  Amount Awarded - $16,474.

We also received confirmation of a further three positive judgments against CLC Paradise, CLC Continental Resorts and Anfi.
